|a Este trabajo tiene como propósito describir los procesos de regulación del principio de neutralidad de la red en Chile, Brasil y Argentina y analizar el sentido y alcance de las distintas normativas. Para ello se define, en primer lugar, en concepto de neutralidad de la red, su origen y aplicación, para luego analizar el principio en la ley 20.453 de Chile, pionera en la implementación en la región: la ley 12.965 Marco Civil de Internet de Brasil y la ley 27.078 Argentina Digital. Ello permitirá realizar un paralelismo normativo y el reconocimiento de los procesos que dieron origen a la regulación, considerando como marco el universo de los derechos humanos, en especial el derecho a la libertad de expresión, íntimamente relacionado con el derecho de acceso a la cultura.

|a This work aims to describe the processes of regulation of the principle of net neutrality in Chile, Brazil and Argentina and analyze the meaning and scope of the different regulations. For this, the concept of net neutrality, its origin and application is defined first, and then, to analyze the principle in law 20.453 of Chile, pioneer in the implementation of the principle in the region, law 12.965 Civil Framework of Internet of Brazil and the law 27.078 Argentina Digital. This will allow for a normative parallel and the recognition of the processes that gave rise to the regulation considering as a framework, the universe of human rights, especially the right to freedom of expression, intimately related to the right of access to culture.
